The NAACP, represented by the Southern Environmental Law Center and Earthjustice, proceeded with the lawsuit after xAI failed to respond to a 60-day notice of intent to sue.

Ben Grillot, a Senior Attorney for the Southern Environmental Law Center, stated xAI's actions are illegal and an "insult" to local families. While some AI companies like Oracle reportedly use gas generators, others such as Google, Meta, and Amazon have invested in nuclear energy to power their data centers.
