Elon Musk, CEO of Tesla, filed an amended complaint in his lawsuit against OpenAI, demanding the ouster of CEO Sam Altman and President Greg Brockman, and that all profits and damages be returned to the OpenAI Foundation, arguing the company abandoned its nonprofit mission.
Musk's filing with the U.S. District Court for the Northern District of California in Oakland on April 7th seeks to remove Altman and Brockman from the for-profit OpenAI and Altman from the nonprofit parent's board. Musk's legal team asserts these executives "repeatedly abandoned their duties and pursued private gain," failing to uphold the foundation's public-interest mission.
The lawsuit also requests the court to mandate that all equity, monetary gains, and revenue from OpenAI's for-profit activities be returned to the foundation. Musk, who contributed approximately $38 million to OpenAI's founding in 2015, pledges to turn over any damages awarded to him from the lawsuit to the foundation.
He insists OpenAI's transition to a for-profit Public Benefit Corporation must be nullified, restoring its original nonprofit structure dedicated to developing AI for humanity's benefit, not a select group of investors. In response, OpenAI sent letters on April 6th to the attorneys general of California and Delaware, urging an investigation into Musk's actions as anti-competitive conduct.
Jury selection for the case is scheduled to commence on April 27th.
