An immigration judge has terminated the removal proceedings against Mohsen Mahdawi, a Columbia University graduate student, a decision announced by his attorneys to the U.S. Court of Appeals for the Second Circuit.

The ruling stems from the government's failure to authenticate a memorandum, purportedly from Marco Rubio, which served as the basis for seeking Mahdawi's deportation. Mahdawi was detained in April 2025 and held for over two weeks, accused of being a threat to U.S. foreign policy solely due to his pro-Palestinian speech.

The ACLU, representing Mahdawi, highlighted the importance of federal court review in immigration cases, especially when First Amendment rights are involved. While the decision was issued without prejudice, allowing the government to appeal or refile, Mahdawi and his legal team expressed gratitude for the upholding of due process against what they termed a "witch hunt." This outcome renews hope for the protection of free speech in a climate where dissent is increasingly met with intimidation.
