The U.S. Court of International Trade has mandated the Trump administration refund over $130 billion in tariffs previously collected under the International Emergency Economic Powers Act (IEEPA).
This order stems from a 6-3 Supreme Court decision that invalidated President Trump's "Liberation Day" and fentanyl-related tariffs on Canada, Mexico, and China, affirming Congress's exclusive constitutional power over taxes and tariffs. Judge Richard Eaton, designated to oversee these refund cases, ruled that all importers who paid these IEEPA duties are entitled to reimbursement, including interest.
While the White House has not commented and potential appeals or delays from the Trump administration are possible, affected businesses, including Atmus Filtration and a coalition of over 1,000 small businesses, are advocating for a swift and automatic refund process. This ruling offers significant financial relief to companies, although the Trump administration has since implemented a new 10% worldwide tariff under the 1974 Trade Act, which also exempts CUSMA-compliant goods.
